Company Requirements
To be able to apply for this financing line, your company must meet the following requirements
- Be a validly constituted company with its own legal personality.
- Accepted legal forms: companies incorporated under the Spanish Capital Companies Act (S.L., S.A. and partnership limited by shares) and, in general, entities whose main activity is economic, i.e. offering goods and/or services in a given market (agricultural transformation companies, cooperatives, worker-owned companies, public business entities, state-owned commercial companies, etc.).
- Not eligible: individuals, self-employed workers, communities of goods, civil or general partnerships, economic interest groupings, joint ventures (UTEs), securities and asset-holding investment companies, nor research organisations and other public or private R&D&I centres, whatever their legal form.
- Associations, foundations, congregations, religious institutions and other non-profit entities are also excluded, even if they carry out economic activity. However, associations and foundations that carry out economic activity on a regular basis and have been registered for business tax (IAE) for at least two years before the application date may be eligible.
- Not be a company in difficulty as defined in Article 2(18) of Regulation (EU) No 651/2014.
- Not be subject to an outstanding recovery order following a European Commission decision declaring aid illegal and incompatible with the common market.
- Be up to date, both the company and the group it belongs to (group as defined in Article 42 of the Spanish Commercial Code), with repayment obligations for any other aid previously granted by CDTI.
- Comply with the supplier payment deadlines set out in Law 3/2004, evidenced by a responsible declaration (required for applications submitted from 1 August 2024).
- Be up to date with tax and Social Security obligations in order to formalise the aid.
- Not be incorporated or established in a country or territory on the EU list of non-cooperative jurisdictions for tax purposes. CDTI will not support actions contributing to money laundering, terrorist financing, or tax avoidance, fraud or evasion.
- Not have relocated to the establishment where the investment will take place from another establishment in the European Economic Area in the two years preceding the application, and undertake not to do so for two years after the investment is completed.
- Have sufficient technical and financial capacity to carry out the project and meet the repayment instalments arising from the aid.
